stata determinante nella formazione di una comune cultura istituzionale e costituzionale della magistratura, contribuendo ad affermarne il ruolo nella società democratica. </span></span><span della credibilità della funzione giurisdizionale e della sua legittimazione democratica non possono considerarsi esaurite con la sola espulsione di Luca Palamara e con l’accertamento delle responsabilità disciplinari.</span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif'><o:p></o:p></span></span></p><p class=MsoNormal style='margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;text-indent:7.1pt;line-height:normal;background:white'><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif;color:black'>Neppure vogliamo accontentarci della narrazione che distingue tra gravità delle colpe e dei comportamenti e accredita Riteniamo, infatti, che al centro della crisi vi siano questioni di fondo che coinvolgono tutta la magistratura.</span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif;color:black'>È un risultato che dobbiamo alla democrazia italiana, ai cittadini e ai tanti magistrati che, negli uffici e riuniti spontaneamente nelle assemblee di base, hanno richiesto una immediata correzione di rotta, invocando un rinnovamento in nome della trasparenza e della partecipazione. </span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif'><o:p></o:p></span></span></p><p class=MsoNormal profonde della crisi, in uno sforzo di riflessione collettiva, critica e autocritica, superando atteggiamenti di autoreferenzialità e preoccupazioni, tattiche e di parte, che hanno condizionato scelte e reso poco leggibili alcune decisioni, nello scorso quadriennio.</span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif'><o:p></o:p></span></span></p><p class=MsoNormal style='font-size:14.0pt;font-family:"Garamond",serif;color:black'>In quest’ottica, ci chiediamo se non si debba riflettere a fondo sulla soluzione di una rigida e predeterminata rotazione annuale delle cariche.</span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif'><o:p></o:p></span></span></p><p class=MsoNormal style='margin-bottom:0cm;margin-bottom:.0001pt;text-align:justify;text-indent:7.1pt;line-height:normal;background:white'><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif;color:black'>L’esperienza dell’ultimo quadriennio ci ha dimostrato che questa prassi, anziché rinforzare la logica dell’unità ed essere funzionale – come sempre è stata – alla piena assunzione di responsabilità, può invece sclerotizzarsi ed essere utile a ricondurre l’immagine dell’associazione al patrimonio del gruppo che di volta in volta ne esprime il vertice. In tal modo non favorisce la partecipazione e quel necessario sforzo di sintesi che, attraverso il dibattito interno, deve essere alla base di un confronto coerente con la politica, in una fase strategica di riforma dell’ordinamento giudiziario e del processo penale.</span></span><span style='mso-bookmark:_Hlk41894186'><span style='font-size:14.0pt;font-family:"Garamond",serif'><o:p></o:p></span></span></p><p class=MsoNormal
