Una pluralità di studi giuridici evidenzia come, nelle moderne democrazie occidentali, il ruolo del pubblico ministero cresca ovunque; nel nostro Paese questa percezione è stata enfatizzata da <strong>una incipiente debolezza delle istituzioni politiche che ha, talvolta, portato il pubblico ministero ad assumere ovvero ad essere percepito come portatore di un ruolo salvifico, a carattere etico, in funzione della tutela della sicurezza pubblica, assecondando una narrazione mediatica che utilizza le paure sociali come motore per indirizzare scelte politiche, commerciali, economiche</strong>.<br/>
Interrogarsi su quanto i modelli normativi vigenti siano conformi alle concrete declinazioni pratiche del ruolo, comprendere <strong>se sia in atto una trasformazione silente della funzione è</strong>, dunque,<strong> uno degli obiettivi dell’incontro</strong>, al fine di assumere nuove consapevolezze, sulla base delle quali avviare una critica ed auto-critica interna alla corporazione e, soprattutto, proporre stili e modi operativi più coerenti con il modello legale.</span></div>

<span style="background-color: transparent;"><strong>NECESSITÁ DI UN'AZIONE PENALE UNIFORME</strong><br/>
Vi è un altro tema che attraversa la figura del pubblico ministero ed è quello della <strong>necessità di garantire l’uniformità dell’azione penale, che è un riflesso della sua obbligatorietà e del principio secondo cui tutti i cittadini sono uguali innanzi alla legge, con la necessità concorrente di garantire la natura orizzontale dei rapporti dentro la magistratura</strong>, in conformità alla regola dell’art. 107 della Costituzione. </span></div>
<div style="line-height: 24px; text-align: justify;"><span style="background-color: transparent;">La gerarchizzazione degli Uffici, in funzione di garanzia dell’uniformità dell’azione penale ha finito per determinare, quale riflesso culturale indotto, l’enfatizzazione del ruolo del capo dell’ufficio, la responsabilizzazione dei sostituti, l’irrituale identificazione dell’Ufficio nel suo dirigente, con conseguente sua sovraesposizione non solo mediatica, ma anche nei rapporti istituzionali e para-istituzionali. </span></div>
<div style="line-height: 24px; text-align: justify;"><span style="background-color: transparent;">Si è, così, generato <strong>un <em>vulnus</em></strong> concreto e percepibile a<strong>lla struttura orizzontale della magistratura cui è necessario porre rimedio, senza rinunciare alla necessità di garantire l’uniformità dell’azione penale</strong>, avendo particolare attenzione alle concrete modalità con cui si sviluppano i rapporti tra dirigenti e sostituti nella concretezza operativa degli Uffici.</span></div>
