L'Avvocato generale della Corte di Cassazione <strong>Pietro Gaeta</strong> si sofferma sull’<strong>indipendenza interna del pm e su come questa sia, di fatto, condizionata prima che dal dato normativo, da un <em>self-restraint</em> culturale dei sostituti procuratori</strong>, specie di quelli reclutati dopo l’introduzione della riforma dell’Ordine giudiziario del 2006. Quindi </span><span style="font-size: 16px; background-color: transparent;"><strong>Alessandra Dal Moro</strong>, consigliera del Csm (ha coordinato i lavori della commissione che ha aggiornato, con la circolare del dicembre 2020, quella del 2017), mette in evidenza <strong>i nuovi strumenti offerti dalla normativa </strong></span><span style="font-size:16px;"><span style="background-color: transparent;"><strong>secondaria per riequilibrare, in senso orizzontale, i rapporti interni all’ufficio di Procura</strong>.</span></span></div>

Per farlo, utilizziamo le parole di un articolo di <strong>Nello Rossi</strong> su <strong><em>Questione Giustizia</em></strong>: «</span>La <span style="font-size:16px;">drammatica conflittualità che connota da decenni il rapporto tra israeliani e palestinesi e <strong>la permanente situazione di crisi di quell’area del mondo non autorizzano una lettura statica del conflitto, della crisi e della loro dimensione istituzionale e giuridica come se si trattasse di realtà sempre eguali a se stesse ed insuscettibili di trasformazione</strong>». Ebbene, occorrono delle letture nuove e adatte a fenomeni nuovi.</span></div>
<div style="line-height: 20px; text-align: justify;">La nostra ottica, che è emersa dall'incontro organizzato da <em>Md</em>, è di assumere il punto di vista del diritto internazionale e dei diritti umani: in quel territorio che va dal Mediterraneo al Giordano, più o meno direttamente controllato da Israele, <strong>abbiamo due popoli di cui uno con pieni diritti e uno che vive in una condizione di degradazione di diritti umani fondamentali, di segregazione, di <em>apartheid</em></strong>. Pronunciamo questa parola con una certa sofferenza, parlando di Isreale, avendo in mente la cultura democratica di questo Paese, il conflitto di memoria e il dibattito che queste tematiche provoca al suo interno, e con rispetto al contributo di alcuni giuristi democratici israeliani. Ma è un tema scottante che non va rimosso: qui si annidano i problemi, perché <strong>non c'è pace senza giustizia, e la giustizia deve passare attraverso una politica di libertà, che consenta la libera circolazione, con la possibilità di avere una terra e delle abitazioni, e il superamento delle detenzioni amministrative</strong>. Sono <strong>tante le prospettive di pace, ma ciascuna non può esistere se, al di là della questione dei due Stati, non si eliminerà l'esistenza di due diritti per due popoli</strong>. L'impegno di <strong><em>Magistratura democratica </em></strong>continuerà su questo terreno.</div>

<div><span style="font-size:16px;">La garanzia di indipendenza interna del pubblico ministero è perennemente in bilico tra due esigenze: l'uniformità dell'esercizio dell'azione e la sua prevedibilità (il fine di tutti i legislatori storici); le ragioni di autonomia del singolo sostituto contrapposte dal Consiglio superiore della magistratura. </span></div>
<div><span style="font-size:14px;">Questo organo è stato una formidabile stanza di compensazione: ha determinato una gerarchia funzionale e <strong>un allontanamento dal modello di intervento diffuso del pm che, invece, le generazioni passate hanno vissuto</strong>. Ma se la <strong>riforma Castelli</strong> ha perso gli scopi coltivati all'origine, essendo stato introdotto un sistema orizzontale,<strong> questa rischia tuttavia di vincere come prospettiva culturale, inoculando l'idea della inevitabilità della verticalizzazione come modello dell'ufficio del pm e quindi come esito organizzativo</strong>. </span></div>
<div><span style="font-size:14px;">L'armonia del modello gerarchico si sposa con lo sfilacciamento dell'obbligatorietà “pura” dell'azione, quella scevra da una organizzazione. I modelli organizzativi predeterminati, che obbligano a delle scelte, comportano strutture tendenzialmente gerarchiche. </span><span style="background-color: transparent;">In sintesi, <strong>tanto più l'obbligatorietà dell'azione diviene da regola costituzionale a principio, tanto maggiore sarà la tendenza a una gerarchia temperata</strong>, funzionale, intelligente, con una direzione sapienziale di un ufficio di procura, comunque lontana dal modello originario dell'agire diffuso.</span></div>
<div><span style="font-size:14px;">Il <strong>principio di gerarchia temperata è direttamente connesso all'incremento della discrezionalità del pubblico ministero</strong>. Questa espansione si lega a una <strong>obbligatorietà che diventa sempre più principio, incomprimibile, ma che non è erogabile illimitatamente, ed è assolutamente bilanciabile con altre esigenze</strong>. L'importante è che su questo<strong> i giudici requirenti abbiano piena</strong> <strong>consapevolezza culturale, principale condizione per affrontare problemi di organizzazione futura</strong>.</span></div>

<div><span style="font-size:16px;">C'erano aspetti di incompletezza, di non adeguatezza della normativa secondaria che abbiamo ritenuto di implementare. Sono quelli che esaltano la natura funzionale del procuratore della Repubblica. </span></div>
<div><span style="font-size:16px;"><span style="font-size:14px;">La legge gli ha attribuito un esercizio esclusivo dell'azione penale e di individuazione delle linee organizzative dell'ufficio. Quindi,<strong> per temperare questo “potere”, lo strumento ritenuto utile è la valorizzazione dell'aspetto funzionale, come compito interno all'espletamento dell'azione giudiziaria</strong>. Si tratta di funzionalità commisurata agli obiettivi di legge, ovvero l'esercizio corretto e uniforme dell'azione penale, l'osservanza delle disposizioni relative all'iscrizione di reato, il rispetto delle norme sul giusto processo. Si prevede anche una valorizzazione del momento partecipativo nella funzione organizzativa, un maggiore coordinamento con il presidente del Tribunale, e una quota riservata di lavoro giudiziario distribuita a discrezione al procuratore aggiunto, in una orizzontalità di sistema.</span></span></div>
<div><span style="font-size:14px;">Alla luce della circolare, poi emendata, <strong>il pm deve valorizzare la partecipazione del proprio ufficio, sentirsi un <em>primus inter pares</em>, condividendo azioni e obiettivi</strong>. Serve un'analisi profonda degli uffici, dei flussi, per il dimensionamento delle scelte organizzative, capire quali gruppi di lavoro creare in modo imparziale. Inoltre, è utile condividere il lavoro del dirigente negli uffici, occorre dare grandi spazi alle riunioni, ai momenti di confronto. Altrettanta attenzione è necessaria alla motivazione di obiettivi generali dei momenti organizzativi, onere espressamente indicato nella circolare.</span></div>

<div style="line-height: 20px; text-align: justify;"><span style="font-size:14px;"><span style="font-size:16px;">Un <strong>pubblico ministero</strong> all'altezza del paradigma costituzionale delle moderne democrazie e dei principi dello Stato di diritto, in qualunque ordinamento, <strong>non può che essere indipendente</strong></span>.<br/>
Dopo la riflessione che abbiamo dedicato al tema alla conferenza internazionale di Firenze nel settembre 2020, abbiamo scelto di confrontarci con specificità e problematiche che hanno a che fare con le concrete dinamiche operative delle Procure, nella loro azione esterna e nella loro dimensione interna, con i diversi modelli di pm che queste dinamiche delineano e con la linea di evoluzione culturale e politica del ruolo del pm che anche per effetto di queste dinamiche si va affermando rispetto alla visione originaria della magistratura delineata dalla Costituzione.<br/>
È stata giustamente richiamata <strong>la “cultura del limite” per definire l'agire del pm, nella consapevolezza che egli non detiene verità assolute e che i risultati delle indagini devono essere verificate nel contraddittorio. Un limite che deve riguardare anche la comunicazione e la presenza il contesto esterno: i rapporti i media, il confronto con l’opinione pubblica</strong>.<br/>
Dobbiamo essere consapevoli delle criticità legate ad un modello di pm che nella prassi, e nella esasperazione mediatica dei risultati investigativi, si allontana dalla cultura della giurisdizione, perde quel ruolo di primo garante dei diritti e delle libertà.<br/>
In questo momento stanno prendendo nuovamente corpo proposte radicali di riforma, favorite dalla grave crisi dell'autogoverno, dall'incapacità della magistratura di intraprendere un percorso condiviso e riconoscibile di forte rinnovamento. <strong>Il senso comune che si è consolidato è che la giustizia di questo Paese non abbia bisogno di una riforma del carcere, di una nuova e differenziata penalità, di razionalità ed efficienza nel processo civile e in quello penale ma di neutralizzare l'autogoverno </strong>(e le sue specificità che ne hanno fatto un esperimento unico di democrazia nell’amministrazione della giurisdizione) e di <strong>rimettere in discussione l'autonomia del pubblico ministero, in controtendenza rispetto a una evoluzione del ruolo del pm che gli assegna il ruolo di primo garante nel processo dei diritti e delle libertà. Il pericolo, non è inutile sottolinearlo, è un assoggettamento del ruolo dei pm all'esecutivo</strong>.</span></div>

<div style="line-height: 20px; text-align: justify;"><span style="font-size: 16px; background-color: transparent;">«</span><span style="font-size:16px;">È discutibile che una forza politica che sta al governo promuova o si accodi a referendum abrogativi su temi di giustizia nel momento in cui è in atto, su tale terreno, una complessa iniziativa legislativa della compagine governativa di cui fa parte». <span style="font-size:14px;"><span style="background-color: transparent;">Lo afferma </span><strong style="background-color: transparent;">Nello Rossi</strong><span style="background-color: transparent;">, direttore di <em><strong>Questione Giustizia</strong></em>, che aggiunge: «Lo <strong>strumento referendario viene m</strong></span><strong style="background-color: transparent;">esso in campo come mezzo di pressione di chi il potere lo ha già e decide di usare l'arma referendaria per sovrapporre i suoi obiettivi all'indirizzo politico di maggioranza o per alterarlo e condizionarlo dall'esterno</strong><span style="background-color: transparent;">».</span></span></span></div>
<div style="line-height: 20px; text-align: justify;">Questo considerazioni provengono da un lungo articolo nella rivista promossa da <em><strong>Magistratura democratica</strong></em>, nel quale Rossi giudica <strong>«improvvisati» e caratterizzati da «frammentarietà» i sei quesiti referendari</strong>, analizzati in dettaglio. Si parte da quello sulla legge Severino, che non vuole cancellare solo le norme che riguardano gli amministratori locali: «<strong>L'intenzione dei proponenti è di chiedere ai cittadini di abrogare l'intero testo unico delle disposizioni in materia di incandidabilità</strong>», con il risultato di spazzare via «le norme che precludono la <strong>partecipazione alle competizioni elettorali per il Parlamento europeo, la Camera dei deputati e il Senato della Repubblica nonché alle elezioni regionali, provinciali, comunali e circoscrizionali di mafiosi, terroristi, rei di fatti di corruzione e di altri gravi reati, che siano stati condannati in via definitiva</strong>».</div>
<div style="line-height: 20px; text-align: justify;">C'è poi un «quesito <em>boomerang»</em> sulla custodia cautelare: «Se non vi sarà rischio di inquinamento delle prove e se non ricorra un serio ed attuale rischio di fuga dell'indagato, <strong>le misure cautelari diverranno inapplicabili al di fuori della sfera ristretta dei delitti di criminalità organizzata, di eversione o commessi con l'uso della violenza o di armi</strong>». <strong>Sulla separazione delle carriere </strong>si è proposto «un <strong>quesito chilometrico, oscuro</strong>, assolutamente impossibile da ricondurre alla netta opzione tra un si ed un no e <strong>destinato</strong>, con ogni probabilità, <strong>a cadere sotto la scure della inammissibilità</strong>».</div>
<div style="line-height: 20px; text-align: justify;">Sulla responsabilità civile dei magistrati si alimenta la «<strong>mera illusione di far credere ai cittadini che il magistrato che sbaglia potrà effettivamente risarcirli di tasca sua</strong>», visto che il magistrato è un «salariato dello Stato» che vive del proprio lavoro e «non dispone di un cospicuo patrimonio». Per questo, «a fronte di danni ingiusti provocati dall'attività giudiziaria, l'unica vera ed effettiva garanzia economica del cittadino è quella offerta dallo Stato». </div>
