Discuteremo di <strong>garanzie e garantismo, diritti, rappresentanza, con lo sguardo rivolto oltre i confini nazionali, puntato sul futuro dell’Europa</strong> e delle sue prospettive inclusive in un momento in cui gli effetti di desocializzazione della pandemia si manifestano in maniera man mano sempre più drammatica.<br/>
<br/>
Siamo ben consapevoli che, nel parlare di democrazia, dobbiamo affrontare il <strong>problema della democrazia all’interno delle istituzioni </strong>che presidiano l’amministrazione della giustizia, a partire dal Consiglio superiore della magistratura. Alla questione democratica, sotto questo particolare profilo, si affianca la <strong>questione morale e la sua declinazione nei rapporti tra istituzioni del governo autonomo e associazionismo</strong>.<br/>
<br/>
Proprio per questo, nel <strong>VII centenario della morte di Dante</strong>, abbiamo scelto come didascalia un verso del<em> Purgatorio</em> <em>(XVI, 97)</em>:<em> “Le leggi son ma chi pon mano ad esse?”</em>.<br/>
<br/>
È una frase, quella pronunciata da <strong>Marco Lombardo</strong>, che ci inchioda al principio di <strong>responsabilità, all’autocritica, all’analisi lucida</strong>. Ci indica, inoltre, la via di un <strong>cambiamento che deve nascere da un rinnovato atteggiamento etico</strong> dei magistrati – singoli e associati – e che non sarà il mutamento delle cornici istituzionali, da solo, a poter determinare.<br/>
<br/>
Affronteremo anche il complesso tema delle <strong>riforme della giustizia</strong>, analizzando le proposte in essere e quelle a cui pensiamo.<br/>
<br/>
La nostra <strong>discussione</strong>, come di consueto, sarà pubblica, trasparente, <strong>partecipata da esponenti della società </strong>che ogni giorno incontrano i reali bisogni delle persone.<br/>
<br/>

C'erano <strong>dei bambini e persino alcuni neonati </strong>tra i migranti che, pochi giorni fa, sono <strong>stati intercettati nel Mediterraneo dalla guardia costiera libica, riportati indietro e chiusi nuovamente nei centri di detenzione</strong>. In totale, <strong>circa duecento persone </strong>che erano state rinvenute e <strong>accolte dalla <em>Vos Triton</em>, nave di appoggio ad una piattaforma petrolifera nel Mediterraneo</strong>, mentre si trovavano, da ore, su una barca di legno con il motore fermo. L'arrivo della motovedetta libica ha comportato il ritorno in Libia dei migranti contro la loro volontà, in condizioni di detenzione, tortura, sequestro. Si tratta di una palese <strong>violazione della Convenzione di Ginevra</strong> e di tante altre norme di diritto internazionale.<br/>
<br/>
«<strong>Nonostante i continui moniti dell'Alto commissariato per i rifugiati dell'Onu in ordine al fatto che la Libia non è un Paese sicuro, pare non arrestarsi il trattamento dei migranti salvati in mare e riportati nel Paese nordafricano. L'episodio della <em>Vos Triton</em> è solo uno dei tanti</strong>». Lo afferma <strong>Riccardo De Vito</strong>, presidente di <strong><em>Magistratura democratica</em></strong>.</div>

<div style="line-height: 20px; text-align: justify;">«<strong>Siamo e saremo sempre interessati come cittadini e giuristi</strong> - aggiunge De Vito - a mantenere alta l'attenzione su questi temi e sul rispetto del <strong>divieto di respingimento stabilito dalla sentenza della Grande Camera della Cedu</strong> (la Corte europea dei Diritti dell'uomo) in data 23 febbraio 2012, nel caso Hirsi Jamaa e altri contro Italia. <strong>Non mancheremo di dedicare attenzione a questi temi anche nel prossimo congresso di Magistratura democratica, previsto a Firenze tra il 9 e l'11 luglio 2021</strong>».</div>

<div style="line-height: 20px; text-align: justify;"><span style="background-color: transparent;">Sono migliaia le persone che, nelle ultime settimane, sono state riportare a Tripoli dalla Guardia costiera, <strong>in assenza di navi Ong, quasi tutte bloccate nei porti da fermi amministrativi dell'Italia</strong>. I fermi amministrativi sono stati disposti dalla Guardia costiera sulla base dei cosiddetti <em>Port state control</em> (Psc), controlli dello Stato di approdo indipendentemente dalla loro nazionalità. Questo tipo di ispezioni servono a verificare che le imbarcazioni commerciali rispettino gli <em>standard</em> di sicurezza per navigazione e lavoro marittimo, nonché di tutela dell’ambiente marino stabiliti da varie convenzioni internazionali. Il sistema dei controlli è, inoltre, uniformato dal <em>memorandum</em> di Parigi e da una direttiva comunitaria. Ecco, dunque, un altro tema: <strong>quali sono i criteri di applicazione del diritto internazionale</strong>?</span></div>

<div>La Commissione nominata dalla Ministra della Giustizia e presieduta da Giorgio Lattanzi ha suggerito, riprendendo precedenti proposte, <strong>di introdurre un procedimento incidentale di controllo del giudice sulla tempestività delle iscrizioni dei nominativi di indagati sul registro delle notizie di reato</strong>.</div>
<div>Tale verifica sarà gravida di <strong>effetti sulle acquisizioni realizzate nelle indagini preliminari, che potranno risultare inutilizzabili se compiute dopo la scadenza dei termini delle indagini</strong> come ricalcolati dal giudice.</div>
<div>Su questa proposta <strong>Nello Rossi</strong>, direttore di <strong><em>Questione Giustizia</em></strong>, lancia un <em>warning</em> sulle pagine della Rivista, rappresentando gli effetti indesiderati che ne potrebbero derivare.</div>
<div>Tra i precetti virtuosi giustamente impartiti al pubblico ministero <strong>sulla necessità di evitare iscrizioni affrettate ed a pioggia</strong> e il potente <strong>deterrente della inutilizzabilità conseguente a iscrizioni che potranno essere ritenute ex post “tardive”</strong>, sarà la minaccia incombente sul procedimento ad orientare l’organo inquirente e a spingerlo <strong>verso iscrizioni il più possibile anticipate e perciò al riparo da ogni successiva contestazione</strong>.</div>
<div><strong>Rischia, così, di riprendere vigore formula dell’iscrizione come “atto dovuto” che si voleva relegare in soffitta</strong>.</div>
