Quelli tesi alla conservazione dei rapporti di potere esistenti? Quelli che spingono per modificarli? In un mondo in movimento, l'inflazione di informazioni rischia di disorientare la consapevolezza del presente e la prospettiva del futuro, mentre i conflitti (generazionali, sociali, economici, demografici, interpersonali) tra diritti esistenti e diritti in formazione interrogano il ruolo della giurisdizione proprio nel momento in cui l'indipendenza della magistratura viene messa in discussione dai sovranismi europei, che tentano di realizzare, anche in Italia, progetti di riforma costituzionale il cui obiettivo dichiarato è proprio quello di indebolire l'autonomia del potere giudiziario e quindi di neutralizzare la sua capacità di rappresentare un centro di tutela, sovranazionale e contro-maggioritaria, dei diritti umani. In questo quadro, sono adeguati gli assetti attuali della giurisdizione? La magistratura riesce a dare risposte efficaci e consapevoli alla complessità dei diritti in cerca di tutela? </em></span></span></p>

<p style="margin: 0;"><span style="color: #000000;">MEDEL -Magistrats Européens pour la Démocratie et les Libertés- esprime forte a preoccupazione per le recenti notizie di ripetuti attacchi mediatici e politici ai giudici italiani, in seguito a decisioni riguardanti i migranti.</span></p>
<p style="margin: 0;"><span style="color: #000000;">Tutto ciò è ancora più grave a causa della contemporanea diffusione di notizie e servizi televisivi sui giudici coinvolti, riguardanti la loro partecipazione a manifestazioni pubbliche e le opinioni espresse in conferenze pubbliche, che dimostrerebbero la loro parzialità.</span></p>

<p style="margin: 0;"><span style="color: #000000;">MEDEL sottolinea il rischio di una deriva verso ciò che è stato osservato in altri contesti, come la Polonia, dove le campagne pubbliche sostenute dai politici per screditare i giudici sono state utilizzate per promuovere riforme, che hanno portato a uno stravolgimento dello Stato di diritto e dell'indipendenza della magistratura, e introdotto l'applicazione di sanzioni disciplinari per i giudici che vanno valere il primato del diritto dell'UE. </span></p>
