> Oggetto: a judge from Turkey
>
> Distinguished President and the members of ADMI,
> I am Dr. ....., used to be a judge in ....Courthouse. Yet, I am not a judge anymore. I am dismissed from the office without defensing myself and not knowing the accusation as many others.
> I have been to .... for almost 1 year due to a research in the University of ...... I got a postdoc scholarship from ....of Turkey in ..... I came here ..... for a 12-month research on the Administration of Justice. I had to go back on ....2016, but I decided not to go under these circumstances and I extended my term for ... months by the help of School Administration.
> I met your declaration on MEDEL's internet page and I wanted to share my story with you.
> One day after the coup attempt on July, 15 in Turkey, a list of almost 2700 judges and prosecutors (over 3500 at the moment) published on the internet sites, and were declared as guilty for assisting coup attempters and overthrowing the government. I am in that list. Indeed, that list consists of those who did not support the government candidates in the HSYK election in October, in 2014. As you may know it is impossible to prepare that list in one night.
> I had been in .... for almost .... months when the coup attempt occured. I do not have a personal or official pistol, nor do many of them in the list, so how could I have assisted the coup or attempted to overthrow the gov.? By texting?
> I was a judge of Turkey 1 year ago and my government sent me here to make a research. Now I have been declared as an assistant of the coup and attempter of overthrowing gov., shortly a terrorist (!), I have been laid off my job, I have been under investigation of ... Prosecution, I had to evacuate my state residence, and prosecution ordered the police to detain me. My house was searched, my computer was confiscated, and my wealth was seized as well, as if I possessed it from a crime. Many judges in many cities have been detained and arrested without enough evidence, just with a list, according to .... who is the lawyer of a judge. In some files the only evidence is a list which sent by the High Judicial Council that I mentioned above. I very much surely know that a judge was arrested just to stay in the house of that organization, which the government declared as terrorist, for a couple of months in 1994. It means, because of a crime, if it is a crime, which was committed 22 years ago. Unbelievable, isn't it?
> Even the members of the Constitutional Court, of the Supreme Court, and of the Administrative Supreme Court were detained and arrested although they have constitutional guaranties both in the Constitution and in the laws of these institutions. Because of the fear of to be declared as a supporter of the coup, even the chairmen of these courts are silent. Some wife and husband judges and prosecutors were detained and arrested and they had to call their parents to come to look after their children. There is an enormous unjust treatment and abuse of rights.
> As you may see in the photographs on the internet sites and on the newspapers, police torture the people in custody. On the internet site named www.adalet.org of which members are jurists, a lawyer named .... who is the lawyer of a few judges and prosecutors claims that the detainees were insulted and humiliated in custody. Her husband whose name is .... wrote on the same site that judges and prosecutors in custody were kept aware, questioned asleep without break, and ten judges were kept for four days in a detention room which is for four people without pillow and blanket. I contacted with Lawyer .... She wrote me that they were threatened and afraid of to be arrested. For a few days, on that internet site, some judges and lawyers mention solitary confinement of judges and prosecutors in turn for 7 to 14 days, and they claim torture. It is insane.
> As a judge who is wanted to be detained and who has any relationship with neither the coup attempters nor the organization which government announced as a terrorist group, I do not want to return to my country under these circumstances and probably I will demand asylum from ....
> I just wanted to you to know what is going on in Turkey from my perspective.
> Please keep my identity secret.
> Best regards
> Dr. .....
